Please read these Terms of Service ("Terms", "Terms of Service", "EULA") carefully before using the Neybo mobile application (the "App") operated by us ("us", "we", or "our").

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.

By accessing or using the App you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the App.

1. Description of Service

Neybo is a local marketplace platform that connects neighbors to buy, sell, and trade goods, as well as hire local service providers ("Services"). We act as a facilitator of these connections but are not a party to the actual transactions between users.

2. Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our App.

You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password.

3. User Conduct & Content

You are responsible for all content (text, images, messages) that you upload, post, email, transmit, or otherwise make available via the App ("User Content").

You agree not to use the App to:

• Post any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, or hateful.

• Sell or offer illegal items, drugs, weapons, or counterfeit goods.

• Impersonate any person or entity.

• Stalk or harass other users.

• Engage in any fraudulent activity or scams.

4. Buying and Selling

• Transactions: Any agreement to buy, sell, or hire is solely between the Buyer and Seller. Neybo is not responsible for the quality, safety, or legality of the items or services advertised.

• Safety: You agree to use caution when interacting with other users. We recommend using our designated "Safe Trade Zones" (e.g., Police Stations, Libraries) for meetups.

• Disputes: Neybo is not responsible for resolving disputes between users. However, we reserve the right to ban users who are reported for fraud or misconduct.

5. Subscriptions and Payments

• Neybo Pro: We offer a subscription service ("Neybo Pro") for $9.99/month that provides enhanced features such as a "Business Badge" and analytics.

• Billing: Payments will be charged to your Apple ID account at the confirmation of purchase. Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.

• Management: You can manage and cancel your subscriptions by going to your App Store Account Settings after purchase.

6. Objectionable Content & Moderation (Apple Compliance)

We have zero tolerance for objectionable content or abusive users.

• Reporting: Users can flag objectionable content or report abusive users directly within the App using the "Report" feature found on every listing and profile.

• Action: We review reported content within 24 hours. We reserve the right to remove any content and eject any user that violates these Terms without refund or prior notice.

• Blocking: You have the ability to block any user. Once blocked, you will no longer see their content or receive messages from them.

7. Intellectual Property

The App and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Neybo and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.

9. Limitation of Liability

In no event shall Neybo, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Washington, United States, without regard to its conflict of law provisions.

11. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
